The Rohini Sessions Court of Delhi has dismissed the bail application of Ruby, an accused in a high-profile acid attack case on her sister-in-law. Ruby had been absconding for the last six years during the trial proceedings and was declared an absconder. She was arrested recently.
Additional Sessions Judge Dhirendra Rana passed the judgment while citing the grievous injuries caused to the complainant as he has lost his vision permanently in one eye and is partially speech impaired. Statements of the complainant were recorded on June 27, 2018, in which the involvement of Ruby was clearly stated; he was proclaimed offender. Ruby was arrested on February 21, 2024.
The court also took into consideration the complainant’s family’s concerns about threats from the accused and his earlier attempts to avoid the process. On these considerations, given the gravity of the injuries and the record of the accused, the court has concluded that it is not a fit case to grant bail.
Vigorously opposing the bail application, Advocate Aditi Drall, who appeared for the complainant, indicated that severe permanent injuries had been suffered by the complainant; including loss of an eye and partial speech impairment. Drall also pointed out that Ruby’s status as a proclaimed offender and the continuing threat of her fleeing trial added to the reasons for her continued detention. She also pointed out that other co-accused are still at large.
Ruby’s counsel, in defense, claimed that she was not aware of the proceedings against her and she had been arrested from her sister’s house in February 2024. Further, it was contended by Ruby’s counsel that the complainant had falsely implicated Ruby and her associates out of revenge, probably because the complainant must have inflicted the injury on her body parts herself. It was also stated by the defense that Ruby was HIV-positive and under treatment, which they requested to be considered in the light of her bail application.
The prosecution narrated the incident of June 17, 2018, when the complainant was attacked by her mother-in-law, sister-in-law, and other associates. The assault is alleged to be with an intent to attack her physically and with an acidic substance. Subsequently, she called her brother and the police immediately. In this connection, an FIR was registered at Shahbad Dairy Police Station.
